What is wh Law doing about this?
wh Law is filing a class-action lawsuit to protect the privacy of children in Illinois. We are looking for parents of children whose facial geometry was scanned by Roblox—in violation of BIPA—to serve as Class Representatives to protect these rights and enforce these valuable legal claims.
What is a class action and how do I join?
In a class-action lawsuit, one or more people called “Class Representatives” sue on behalf of other people who have similar claims. The people together are a “Class” or “Class Members.” One court resolves the issues for everyone in the Class – except for those people who choose to exclude themselves from the Class. The people who sue are called the “Plaintiffs.” These individuals are each from Illinois and claim that their children had face templates created and stored by Roblox.

What is “biometric data,” and why is Roblox collecting this from children?
When your children play Roblox, they may be giving up more than their free time. Based on our ongoing investigation, we believe that Roblox is encouraging kids to provide biometric data when they sign up to use certain services to play the game.
Specifically, if your child uses Roblox’s “voice chat” feature, he or she has had to submit uniquely identifying scans of his or her face in order to utilize the feature. While Roblox claims that they are doing this for purposes of age verification, what Roblox does not explain to these children is that it is using sophisticated artificial intelligence to create faceprints—as uniquely identifying as a fingerprint—in order to accomplish this task.
But Illinois law specifically prohibits this kind of exploitation of unique personal information. The Illinois Biometric Information Privacy Act (“BIPA”) says companies can’t collect, store, or give out “biometric data,” which includes things like face or fingerprint scans, without first giving notice and getting consent.
We believe that Roblox uses facial recognition technology to create face templates—unique templates that can be used to identify users in photos—that these templates are covered by BIPA, and that Roblox is doing this to children in a way that clearly violates BIPA.
That is correct, we believe that the collection of your child’s biometric facial print violates Illinois law and Roblox should have to stop.
